Terms & Conditions

1. Standard Terms
   • 1.1  Entry into this competition is deemed to be an acceptance of these Terms and Conditions.
   • 1.2  Information on entry forms and the prize itself form part of these Terms and Conditions.
2. Entry Details
   • 2.1  Entry is open to all residents of Australia, except residents of New South Wales or the Australian Capital Territory. Employees and officers (and their immediate families) of the Promoter, its related entities and the Promoter’s agencies associated with this competition are ineligible.
   • 2.2  Entry for the competition commences and closes when promoter decides. The Promoter may extend the time for, vary or terminate this promotion at any time in its absolute discretion.
   • 2.3  To enter, Participants must must give ECOTECH their name and contact details and/or subscribe to the ECOTECH Together magazine via the website at ecotech.com/subscribe-to-together. Cost of entry via the internet is free, but internet connection and usage rates may apply – Participants should obtain details of such costs from their service providers.
   • 2.4  Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of submission by the Participant.
   • 2.5  Participants may only enter the competition once.
   • 2.6  An entry is invalid if illegible or incomplete.
3. Determining the winner
   • 3.1  The winner will be selected by the Promoter at random.
4. Prize
   • 4.1  The winner of the prize will receive an item valued at approximately based on the recommended retail value of the prize at the time of the commencement of this Promotion. The Promoter takes no responsibility for variation in prize values..
   • 4.2  If a prize becomes unavailable for any reason, the Promoter may in its absolute discretion substitute a replacement prize that the Promoter determines is of equivalent or greater value.
   • 4.3  The winner will be contacted by the Promoter. The winner will be required to provide the Promoter the following details in order for the Promoter to notify the winner that he or she has won and to send the prize to the winner:
     • name of winner;
     • postal address of winner; and
     • contact telephone number.
   • 4.4  The winner may be required by the Promoter to be photographed with the prize.
   • 4.5  The winner acknowledges and agrees that the winner’s name and photograph may be published in subsequent editions of the Together magazine, in ECOTECH promotional material and/or on the ECOTECH website.
   • 4.6  A prize is not transferable, exchangeable or redeemable for cash or alternative items.
   • 4.7  If the winner is under the age of 18 years, the Promoter may, in its absolute discretion, award the prize to the winner’s parent or guardian.
   • 4.8  The winner of the prize may be required to produce identification in a form acceptable to postal services before collection of the prize and may be required by the Promoter to sign an acknowledgment that he or she has received the prize.
   • 4.9  If the winner is not prepared to provide the details specified in paragraph 5.3, be photographed as specified in paragraph 5.4, permit the publication of the winner’s name and/or photograph as specified in paragraph 5.5, or is not readily identified and reasonable efforts have been made to identify the winner, the Promoter may conduct a further draw to determine a new winner.
   • 4.10  The Promoter’s decision in relation to any aspect of the Promotion is final and no correspondence will be entered into.
   • 4.11  The Promoter makes no representations or warranties as to the quality, suitability or merchantability of the prize and excludes all implied warranties to the extent permitted by law.
5. No Liability
   • 5.1  The winner accepts the prize at his or her own risk. The Promoter will not be liable for any claim, cost, expense, loss, damage or liability whatsoever suffered or incurred (including but not limited to indirect or consequential loss), or personal injury suffered or sustained, as a result of or arising out of or in any way connected with the conduct of this competition or the acceptance or use of a prize, except for any liability which cannot be excluded by law. The Promoter may in its sole discretion require the winner and any person participating in a prize to sign a deed of release and indemnity in a form acceptable to the Promoter prior to awarding the prize to the winner.
   • 5.2  The Promoter will not be responsible for any lost, late or misdirected entries. The Promoter is not responsible for any incorrect or inaccurate information or any failure of equipment or other technical error that may occur in the course of the administration of this competition, including any technical malfunction of any software, servers or providers, technical problems, traffic congestion or any other technical issues. The Promoter is not responsible for destruction, theft or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any injury or damage to participants’ or any other person’s computer or other equipment related to or resulting from participation in or downloading any materials in this competition.
   • 5.3  The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or any software used in the course of the promotion.
6. Privacy
   • 6.1  The Participant is providing information to the Promoter.
   • 6.2  All entries become the property of the Promoter. Your personal information is safeguarded by privacy law. The Promoter needs the requested information to process your entry and to contact you in the event that you win the competition. Participant’s contact details may be provided to others assisting in the administration of the Promotion, including prize suppliers and deliverers. Participant’s contact details may be entered into a database for future promotional marketing and publicity purposes, unless notified to the contrary by you. You can ask to see your personal information which the Promoter holds.
